Material Safety data Sheets ( MSDS ) are available for all products supplied by us and can normally be downloaded directly from the relevant MSDS page. Please ensure that you refer to the relevant data sheets for products purchased To ensure the safe usage, handling & storage of our products.
Correct application methods and coverage rates are included in the individual products description
In the event of an MSDS sheet not being available please contact us for a copy before use.
All products are supplied and provided on the condition that we MVMSYSTEM Ltd cannot be held responsible in the event they are used for any other purpose other than that explicitly specified by ourselves.
Any recommendations and advice offered are given without legal responsibility. MVMSYSTEM Ltd shall not be liable to the customer in the event of damage to goods or injury to persons resulting from negligent or improper use or handling of goods by the customer, their employees or their agents or members of the general public, or any loss of profit or contracts or other consequential losses of any kind however caused.

Availability
All items are subject to availability but are usually Ex-Stock for same day shipment if ordered before 3:00 PM ( 15:00 Hrs. )

Delivery
We will endeavour to despatch all of our products if ordered before 3:00 PM ( 15:00 Hrs. ) that day for delivery to the UK Mainland, Scottish Highlands & Islands, Northern Ireland & Eire & I.O.M by A.P.C Couriers Next Day Service or if that next day service is not available for that specific area, the next best available APC service for that area.
We strongly urge customers to provide a daytime telephone number to enable the courier to effect an on time delivery, this information will not be shared with any third party
For International deliveries MVMSYSTEM Ltd will use customers nominated carriers on customer’s specific accounts or choose a carrier acceptable to both parties
Whilst MVMSYSTEM Ltd makes every effort to ensure that all deliveries are effected on time, MVMSYSTEM Ltd will not be held responsible for non- deliveries, breakages, storage, demurrage & similar charges & deliveries outside the nominated specified delivery time caused by any carrier
Where goods are returned to MVMSYSTEM Ltd as Being undeliverable by the carrier, MVMSYSTEM Ltd reserves the right to charge the customer for the returns & re-delivery charges charged To MVMSYSTEM Ltd by the carrier
No claim for damage in transit, shortage of delivery, or loss of goods will be entertained by MVMSYSTEM Ltd,
In the instances of damage in transit or shortage of delivery, a separate notice in writing must given to both the carrier concerned and to MVMSYSTEM Ltd at the time of that delivery . MVMSYSTEM Ltd must receive a complete claim in writing at its head office within three days of that delivery. In the case of loss of goods, MVMSYSTEM Ltd and the carrier concerned must receive, at their relevant Registered Offices a complete claim in writing made within ten (10) working days from date of despatch.
Time Of Essence Clauses in any format or guise are totally unacceptable to MVMSYSTEM Ltd
Any time or date nominated by MVMSYSTEM Ltd for delivery is given and intended as an estimate only and MVMSYSTEM Ltd shall not be liable to make good any damage or loss whether arising directly or indirectly from the delay in delivery.
In exceptional circumstances where a period is named for delivery and such period is not extended or varied by mutual consent in writing, the customer shall take delivery within that revised period if :-
In the event of a stoppage, delay or interruption of work in the establishment of either MVMSYSTEM Ltd or the customer during the nominated delivery period as a result of strikes, lock-outs, trade disputes, breakdowns, accidents or any cause whatsoever beyond the control of MVMSYSTEM Ltd or the customer respectively.
Deliveries may be wholly or partially suspended and the time of such suspension added to the original contract.
Or
In the event of an outbreak of hostilities (whether war is declared or not) in which the United Kingdom is involved, or in the event of a National Emergency, or if MVMSYSTEM Ltd.’s production facility should become either directly or indirectly engaged on Government orders or orders under priority directions which prevents or delays work on other orders, MVMSYSTEM Ltd shall be entitled at any time, on notice to the customer, to make partial deliveries only or to determine the contract, without prejudice in any case to rights accrued in respect of deliveries already made.
Deliveries may be wholly or partially suspended and the time of such suspension added to the original contract

Complaints
Any complaints by the consumer will be dealt with in a fair, effective and confidential manner. Complaints must be submitted in writing to our offices and will be acknowledged within seven ( 7 ) working days. MVMSYSTEM Ltd agrees to provide a likely timescale to resolve the dispute and keep the consumer informed about progress.

Cancellation Of Order
Once an official order has been received either verbally or in writing, a contract is deemed to have been entered into between MVMSYSTEM Ltd and the customer. Cancellation of the contract will be solely at the discretion of MVMSYSTEM Ltd.
Cancellation of an order will not be accepted in any circumstances where a product has been specially made to fill that order. A charge of 25% will be made for goods that are of merchantable quality as determined by MVMSYSTEM Ltd.

Returned Goods
It is our general policy not to accept return of goods.
In exceptional circumstances standard products may be returned to us within ten (10 ) working days of date of delivery provided that the customer has written agreement from MVMSYSTEM Ltd to effect such a return.
No claims will be entertained for returns outside this period.
Goods are to be returned at the customer’s expense to the original source of supply as specified by MVMSYSTEM Ltd and a re-stocking charge of 25% will be made for goods that are of merchantable quality as determined by MVMSYSTEM Ltd.
Not all goods may be accepted back into stock for credit.
Any refund made will not take into consideration the actual original carriage cost ( not the website charge of £ 5 including VAT ) incurred in shipping the product to you.

If you open the original containers then we will not be able to offer the goods for resale as new so we will not be able to offer you a refund.
We are unable to offer refunds on items that have been especially made for you.
Return shipment will be at your own cost by your own courier. We will not arrange a third party collection on your behalf.
When returning goods we recommend that you use a carrier who offers shipment tracking and that you insure the package for its full value. You will be responsible for any loss or damage to the goods during transit.
Returned goods will be weighed & basic tests of specific gravity & ph performed to ensure that the returned item conforms exactly to the dispatched item

Defective Goods
You are required to immediately inspect the received goods and advise us within twenty four (24 ) hours of receipt of any damage or shortages. Our carriers will not accept any responsibility whatsoever for damaged goods or shortages reported after twenty four (24 ) hours
Goods purported & represented by the customer to be defective shall not form the subject of any claim for work done by the customer or for any consequential loss, damage or expense whatsoever arising directly or indirectly from such alleged defects.
However such goods, if returned to MVMSYSTEM Ltd and accepted by them as defective, will if requested by the customer be exchanged for an identical item exactly as originally ordered.
Defects in quality or volume in any delivery shall not be the basis or grounds for cancellation of the remainder of the order or contract.

Title Of Goods Websales
Title of the goods passes to the customer when online secure payment or telephone payment is made & goods are delivered to the customer by our courier

Title Of Goods 15 Day accounts
Title to the products supplied shall pass to the customer when MVMSYSTEM Ltd provides the products to for delivery to the customer, or where applicable when the customer or its nominated carrier collect the products from MVMSYSTEM Ltd.’s premises.
The exceptions to the passage of title are
The customer’s right to possession of the products shall end immediately if it:
Makes any arrangement with its creditors or otherwise takes the benefit of any statutory provision for the relief of insolvent debtors, or convenes a meeting of creditors, or enters into liquidation, or has a receiver and / or manager, administrator or administrative receiver appointed, or documents are filed for the appointment of an administrator of the customer or notice of intention to appoint an administrator is given by any entitled person or a resolution is passed or a petition presented to a court to wind-up the customer or for the grant of an administration order or any insolvency proceedings are commenced relating to the customer
Suffers or allows any execution to be levied on its property or obtained against it or breaches any of its obligations under any contract or any other contract with MVMSYSTEM Ltd or is unable to pay its debts within the meaning of section 123 of the Insolvency Act 1986 or ceases to trade.
Encumbers or in any way changes any of the products.
If the customer shall make any default in or commit any breach of his contractual obligations to MVMSYSTEM Ltd.
Or if any distress or execution shall be levied upon the customer his property or assets or if he (the customer) shall make, or offer to make, any arrangements or composition with creditors or commit any Act of Bankruptcy.
Or if any Petition or Receiving Order in Bankruptcy shall be presented or made against him.
Or if the customer shall be a limited company and any Resolution to wind up such company’s business shall be passed or presented otherwise than for reconstruction or amalgamation.
Or if a Receiver of such company’s undertaking property or assets or any part thereof shall be appointed.
MVMSYSTEM Ltd shall have the right forthwith to determine any order then subsisting and upon written notice of such determination being posted by it to the customer’s address for service specified herein any subsisting order shall have been deemed to have been determined without prejudice to any claim or right MVMSYSTEM Ltd might otherwise make or exercise.

 

TREATMENT ON BOARD VESSELS

NX2FLAMETECT is solely supplied by MVMSYSTEM in a joint venture with ECO-SOL MARINE Ltd.

NX2FLAMETECT for marine application as per MGN 453 requirements and application only by MVMSYSTEM or its qualified Contractor. Application is subject to owners or their nominated and approved agent signing the quotation form with all relevant details. To secure treatment dates a deposit of 50% or a min of 750 GBP (the greater of the two) on total estimate will be required by Customer. Acceptance of payment will be subject to monies available in MVMSYSTEM allocated Bank account or approved credit Card transaction.

The customer will be responsible for correct address for despatch of NX2FLAMETECT containers if required and can not be carried on board by contractor. Release of NX2 from customs is sole responsibility of Customer and their agents including any costs involved. ECO-SOL Ltd. has years of experience with delivery of the material globally with no known restrictions to date. This does not mean that changes in local legislation may ,or may not, allow entry to some or other destinations. If in doubt check with local agent using NX2FLAMETECT MSDS sheet prior to ordering.

When ordering a treatment , quantities will be calculated for the required materials by MVM. An extra quantity of 10% – 15% will be allowed in shipment to cover extra material requiring treatment that has not been included by the customer in original quotation. Such added treatment will be calculated per SQM treated , rounded to nearest value in .5 SQM . Cost will be at standard quoted cost as per original quotation. Quotation for application in Europe / Med and South Africa will include traveling expenses for a min. treated area of 300 msq. For USA and Middle East min. treated area of 400 msq. For Australia and Far East, Travel expenses will be quoted as a seperate unit regardless of treated area required.

Customer will supply in original quote status of items to be treated and if items were cleaned , this process should be done prior to MVMSYSTEM application. If on arrival on board MVMSYSTEM or its contractor deem an item to be soiled and not allowing treatment as per audited procedure, customer will be notified and item will be removed from original quote and marked as not treated. Customer may decide to clean the item in which case any delay in treatment will be billed if outside the scope of original quote + expenses at cost + 10%.
MVMSYSTEM and/or its contractors cannot be held liable for any chemical reactions that may occur due to previous cleaning procedures conducted on the materials treated.

MVMSYSTEM will regard treated items as New only if they have been purchased and supplied prior to use on board within a limited period of 30 days from invoice or proof of supply. Such Items will be deemed New if no treatment involving chemicals or any other substance and /or soiling have occurred. In such cases where chemical reaction has been witnessed after treatment with NX2 a sample shall be provided for testing and assessing. Results shall be addressed by Both Parties and an agreed solution shall be reached. All Other Items supplied for treatment shall be deemed as Used and as such MVMSYSTEM do not take any responsibility. This is fully understood by Customers and /Or owners representative when signing request for treatment.

If any material has been miss represented in quote by type or estimated weight per sqm this may be recalculated and added or subtracted where necessary.
Calculation of Material of dense weave and above 300 gr/m2 may require application on both sides. This will require calculations to be adjusted from Quotation to “as applied”.

If any material is of an unknown nature / type and MVM sees it necessary to test a sample prior to application , customer will be given notice and action shall be decided. Materials that are unique and unidentifiable for treatment may require further testing by MVMSYSTEM and ECO-SOL to assure treatment will follow guide lines and MGN453 requirements.

All items treated on board will be documented and logged.
A report assessing the treatment and a certificate will be issued to the vessel within 21 days of completed treatment and subject to full payment, balance received. As per Audit Trail MVM confirms that Treatment is complete only when a Signed and Sealed Report + Laminated and Sealed Certificate are issued to the Vessel. Draft electronic reports for remarks by customer are not acceptable as final treatment.

Treatment report will include original NX2 Lables taken off containers used for the vessel treatment and will be stamped along batch numbers. This serves as proof that containers will not be available for reuse, refill etc’.

Final Hard Copy Treatment Report will include a cover Document of Compliance stamped and sealed by MVMSYSTEM.This page will verify originality of report and can not be introduced as a copy. This will serve as proof of Treatment and audit trail to Flag / Class or any other authority.

Seals are golden leafed and stamped with MVMSYSTEM company stamp.

For report and records vessel most supply in Quotation form copy of valid Certificate of Vessel Registration and if flagged outside UK and EU will be exempt VAT.

Report will be issued in two copies . Further copies will be charged at a fee as agreed with MVMSYSTEM.

Vessels requesting voluntary treatment and not required by their Flag or Class will be issued certificate only at a cost of 120.00 GBP (Vat plus postage where applicable).

Cancellation of treatment  due to customer request can be done prior to travel arrangements being booked or  no later then 30 days prior to agreed treatment day.

This will carry a 10% administration fee on deposit paid of 50% or a min of 750 GBP (the greater of the two). MVMSYSTEM will return the remaining balance via Bank transfer to designated Customer Bank within 35 days of cancellation being accepted.

If customer requires dates or location or both to be moved after booking this can be arranged subject to any costs + 10% handling fees charged to Customer. This will be subject to availability of MVMSYSTEM and its contractor on requested dates.

Following MVMSYSTEM treatment with NX2FLAMETECT , all items recorded in report will be covered for a period of not more then 24 months from date of treatment. This is subject to maintenance procedures and cleaning adhered to as per MVMSYSTEM instructions. MVMSYSTEM adds a water based die within the fabrics allowing future inspection of item for any wet cleaning or other non conformity cleaning process conducted. If this happens then the item will require re-treatment and will not qualify as treated. If this is found  in a number of items and vessel confirms to MGN453 , notice will be issued to Flag of the findings and nullification of Record unless re-treatment has been agreed within 14 days of findings.

Late Payment Fees
All late payments will be charged at a fixed interest of 10% for all outstanding amounts due to MVMSYSTEM for vessel treatment. Late payment will be regarded as of 7 days past due payment date as indicated in inital agreement or invoice to customer. Added 10% will be for any period of late payment in blocks of 30 days or part of.
